The U.S. International Trade Commission (USITC) has voted to launch an investigation(337 investigation) into specific disposable and other closed-system electronic nicotine delivery systems (ENDS) devices and their components. The products involved in this probe are detailed in the Commission’s official notice of investigation.
This inquiry stems from a complaint lodged on January 13, 2026, by R.J. Reynolds Tobacco, R.J. Reynolds Vapor Company, RAI Services Company, and Reynolds Marketing Services—all based in Winston-Salem, North Carolina. An additional submission was made on February 3, 2026. The complaint, as amended, asserts breaches of section 337 through the importation and sale of certain disposable and other closed-system ENDS devices and parts in the U.S.
These alleged violations involve unfair competition methods and practices tied to: (1) infringements of the Prevent All Cigarette Trafficking Act (PACT Act), 15 U.S.C. § 375 et seq., (2) violations of state or local flavor bans, (3) noncompliance with state directory mandates, and (4) failure to adhere to state or local excise taxes, with the potential to significantly harm or undermine a domestic industry.
The complainants are urging the Commission to issue a general exclusion order, or alternatively, a limited exclusion order, along with cease and desist orders.

By initiating this 337 investigation (337-TA-1486), the USITC has not reached any conclusions on the case’s substance. The matter will be assigned to one of the USITC’s administrative law judges (ALJ) by the Chief ALJ, who will organize and conduct an evidentiary hearing. The ALJ will issue an initial ruling on whether section 337 has been violated, a decision that the Commission can later review.

The USITC aims to deliver a final ruling in this probe as promptly as possible. A target date for wrapping up the 337 investigation will be established within 45 days of its commencement. Remedial orders from the USITC in section 337 cases take effect upon issuance and become conclusive after 60 days, unless the U.S. Trade Representative rejects them for policy reasons during that window.
