Federal Authorities Moving to Ban Juul Vape Products to Address Youth Relevant Concerns on Vaping

The Wall Street Journal reports that the FDA is gearing up to impose a ban on Juul vape products while removing the existing products of Juul Labs from the market. However, the journal also claims that after reviewing the application from Juul to be allowed to continue to sell products with non-fruit flavors, the e-cigarettes from Juul could still be banned by this Wednesday.

Hundreds of companies like Juul had submitted marketing applications to the FDA for reviews as anti-tobacco groups requested it to conduct a crackdown on products that promote vaping. The other side of the picture, however, depicts advocacy for the products as they are believed to be able to allow smokers to adjust to a life without smoking. And this ban on Juul vape products would not be in favor of this possibility.

According to an FDA spokesperson, Juul was unaware of the decision made by the agency on their application. Juul also had no comment on the report straight away.

Two years back, in 2020, all companies related to vaping and e-cigarettes were asked to submit marketing continuation applications for their products by the FDA. It also excluded mint and fruit-flavored juice pods from the allowed products used in vaping products and e-cigarettes. Surprisingly, products with tobacco and menthol flavor were not banned.

FDA also rolled out a massive ban in September on vape products, including e-cigarettes, while there was no ban on Juul vape. According to – the national assistant vice president of advocacy of the American Lung Association – Erika Sward, the FDA’s ban on Juul vape-related products, especially tobacco and menthol-flavored products, was expected for a long time.

She further reasoned that Juul seems to be not a company that has regard for children’s health; therefore, their products should not be allowed to be available to the public.

Theodore Wagener believes the regulators at FDA might have decided that the Juul products are still appealing to youth, which does not align with the marketing application’s requirement. Wagener is a co-leader at Ohio State University Comprehensive Cancer Center in the Cancer Control Program while also working as the Center for Tobacco Research’s active director.

The rate of underage youth involved in vaping is declining after touching high peaks in the last decade. In 2020, 19.6% of high school students used to vape, and 11% in 2021, claims the National Youth Tobacco Survey. And Wagener believes the decline will continue.

Based on his involvement in an ongoing study about how smokers perceive the role of vaping in helping them to quit smoking while switching to e-cigarettes and other such therapies for replacing nicotine.

He believes ventures like the ban on Juul vape products and other limitations might drive adult smokers away from adopting e-smoking. This will definitely decline the number of people who successfully quit smoking by switching to e-cigarettes with lesser or no nicotine and are very satisfied with the transition.

Cannot be sold in the U.S. market JUUL, where else can go?

It has withdrawn from Europe, Asia, and other countries to focus on the U.S. market, stopped all kinds of advertising, pay all kinds of fines, stops selling fruit flavors, which still does not help.

The founder’s first departure seems to have doomed the end of JUUL, and OCHA’s investment of more than $12 billion looks to have gone down the drain.

Will JUUL’s removal from the U.S. market give competitors new opportunities, such as NJOY and VUSE, which have already passed the PMTA? Although the past product form is backward, after all, stay in the market, JUUL is currently there is no chance to compete with them.

That said, British American Tobacco’s VUSE should not be too excited, maybe the VUSE Alto application will also be fierce.
