The FDA has issued warning letters to 115 retailers for selling unauthorized disposable e-cigarettes from Chinese manufacturers, including Geek Bar Pulse, Geek Bar Skyview, Geek Bar Platinum, and Elf Bar.
These actions are part of the FDA’s ongoing enforcement efforts, which are carried out in collaboration with state and local partners. The agency works with states, territories, and third-party entities to conduct compliance inspections of retail establishments.
According to the 2024 National Youth Tobacco Survey, 5.8% of current youth e-cigarette users reported using Geek Bar products. Additional data from the FDA’s surveillance and the Population Assessment of Tobacco and Health Study further indicate that the Geek Bar brand is popular among youth and considered appealing to this demographic.
Retailers receiving the warning letters have 15 business days to respond with a corrective action plan outlining how they will address the violation and prevent future occurrences. If the violations are not corrected promptly, the FDA may take further actions, including injunctions, seizures, or civil penalties.

For a tobacco product to be legally marketed, it must have FDA authorization. Products without authorization are subject to potential enforcement actions. As of now, the FDA has approved 34 e-cigarette products and devices.
